By using this service, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Family Trust Builder ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, visitors, and others who access or use the Service.

2. Description of Service

Family Trust Builder is a document preparation service that helps users create revocable living trust documents. The Service:

  • Provides state-specific trust document templates
  • Guides users through a step-by-step workflow
  • Generates PDF documents based on user-provided information
  • Offers general educational information about trusts
  • Provides guidance on asset transfer and document execution

3. User Eligibility

To use this Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information
  • Comply with all applicable laws and regulations
  • Not be prohibited from using the Service under applicable law

4. Payment and Fees

4.1 Service Fee

The Service costs $49.99 per trust document (one-time payment). Payment is required before you can download your completed trust document.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms and conditions. We do not store your credit card information.

4.3 Refund Policy

All sales are final. Due to the nature of digital document delivery, we do not offer refunds once you have completed payment and downloaded your trust document.

We encourage you to:

  • Carefully review all information before completing payment
  • Use the review screen to verify your entries
  • Understand what you are purchasing before proceeding

5. User Responsibilities

You are solely responsible for:

  • The accuracy and completeness of all information you provide
  • Reviewing documents for errors before downloading
  • Ensuring the documents meet your specific needs
  • Consulting with legal, tax, and financial professionals as needed
  • Properly executing documents according to state law
  • Transferring assets to your trust as intended
  • Maintaining the confidentiality of your account information
  • All activities that occur under your session

6. Prohibited Uses

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Provide false, inaccurate, or misleading information
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service
  • Copy, modify, or distribute the Service or its content
  • Reverse engineer or attempt to extract source code
  • Use the Service to create documents for others commercially
  • Violate any applicable laws, regulations, or third-party rights

7. Intellectual Property

7.1 Service Content

The Service and its content (including templates, software, text, graphics, logos, and interface) are owned by or licensed to Family Trust Builder and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Documents

You retain all rights to the documents you create using the Service. However, the underlying templates and software remain our property.

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal use only. This license does not permit you to resell, redistribute, or commercially exploit the Service.

8. Privacy and Data Protection

Your use of the Service is subject to our privacy practices:

  • We collect only the information necessary to provide the Service
  • Your personal information is stored securely
  • We use session-based storage for your workflow progress
  • Payment information is handled by Stripe (we do not store card details)
  • We do not sell or share your personal information with third parties
  • You are responsible for the confidentiality of your session data

9. Disclaimers and Warranties

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of information
  • Uninterrupted or error-free operation

9.2 No Legal Advice

WE ARE NOT A LAW FIRM. THE SERVICE DOES NOT PROVIDE LEGAL ADVICE. Use of the Service does not create an attorney-client relationship.

9.3 State Law Variations

Trust laws vary by state. We do not guarantee that documents will be legally valid or enforceable in your jurisdiction.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILY TRUST BUILDER AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • Direct, indirect, incidental, or consequential damages
  • Loss of profits, revenue, data, or goodwill
  • Personal injury or property damage
  • Damages arising from use or inability to use the Service
  • Legal consequences of executing documents created through the Service
  • Errors, omissions, or inaccuracies in documents or information

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE ($49.99).

11. Indemnification

You agree to indemnify, defend, and hold harmless Family Trust Builder and its owners, operators, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Information you provide through the Service
  • Documents you create using the Service

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for updates.

13. Termination

We reserve the right to:

  • Terminate or suspend access to the Service at any time
  • Refuse service to anyone for any reason
  • Modify or discontinue the Service without notice

Upon termination, you must cease all use of the Service. Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) shall remain in effect.

14. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except for disputes seeking injunctive relief or involving intellectual property rights.

14.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis only and not as a class action or representative action.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Legal Notice, constitute the entire agreement between you and Family Trust Builder regarding the Service and supersede all prior agreements and understandings.
